Please note, if you are married, only one of you should complete the answers on behalf of the entire household. All answers pertain to 2021. If you have no dependents, feel free to skip to the next section. All others, please read the following Dependency Overview and answer the 2 questions that follow.

 

Dependency Overview:

 

To claim a dependent on your tax return, the person you are claiming must be a Qualifying Child or Qualifying Relative. The person you claim cannot be married and must be a US citizen, resident alien, or a resident of Mexico or Canada.

 

To be a Qualifying Child, the person must:

a)     Must be your child, stepchild, eligible foster child, brother, sister, stepchild, or descendent of any of them, and

b)     Be under age 19, or a full-time student under age 24, or totally and permanently disabled, and

c)      Live with you more than half the year, and

d)     Not provide more than half their own support, and

e)     Not file a joint return (unless only to claim a refund), and

f)      Not be a qualifying child of any other taxpayer entitled to claim then under tie-breaker rules.

 

To be Qualifying Relative, the person must not be the taxpayer's or anyone else's Qualifying Child, and either live with you all year or be related to you and have less than $4,300 in gross income for the year.

 

Custody Issues: Only one parent can be considered the "custodial" parent. For a non-custodial parent to claim the child, the custodial parent must release their claim by signing Form 8332 which has to be filed with your return. If your right to claim the dependent is challenged you may need to provide information

 

Earned Income Credit: To qualify for earned income credit, you must be a US citizen or resident alien for all of the tax year.


Dependents must be your son, daughter, stepchild, foster child, or a descendant of any of them (for example, your grandchild), or brother, sister, half-brother, half- sister, stepbrother, stepsister, or a descendant of any of them (for example, your niece or nephew). The dependents can not be married and they must live in the US with you for more than half the year, regardless of how much support you provide to them.


Sometimes a child meets the tests to be a qualifying child of more than one person. However, only one of these persons can actually treat the child as a qualifying child. Only that person can use the child as a qualifying child.
