Acknowledgement of Safety Protocols
To support a safe and healthy environment for the California Council for Affordable Housing September 27-28 Fall Meeting, attendees must be fully vaccinated or have had a negative COVID test result between 5:00 PM PST on Friday, September 24, and arrival at the event on September 27-28. Safety Protocols Information and Waiver
In consideration of the Participant listed below being permitted to attend and/or participate in the California Council for Affordable Housing 2021 Fall Conference on Monday, September 27, and Tuesday, September 28, 2021 at the Sheraton Grand Hotel Sacramento ("Event") operated or hosted by the California Council for Affordable Housing, and by signing this Release, I, the Participant [or I, the Participant’s parent or legal guardian that has signed below, on behalf of myself and the Participant (together, referred to as “Participant”,] acknowledge and agree as follows:
- That COVID-19 has been declared a worldwide pandemic by the World Health Organization.
- That COVID-19 is extremely contagious, and exposure to infection can result from person-to-person contact, including but not limited to breathing, coughing, interacting with other individuals, touching surfaces, among other methods, and contracting COVID-19 can result in personal injury, illness, permanent disability, and death.
- That anyone traveling to or from, or participating in or attending the Event can become infected with COVID-19.
- That the risk of becoming exposed to or infected with COVID-19 by participating in or attending the Event may result from the actions, omissions, or negligence of California Council for Affordable Housing and its employees, agents, volunteers, representatives, providers, visitors, licensees, and any other person that is attending or participating in the Event.
Participant understands that while the California Council for Affordable Housing has undertaken reasonable steps to lessen the risk of transmission of COVID-19 in connection with the Event, the California Council for Affordable Housing cannot guarantee that Participant will not become exposed to or infected with COVID-19. Further, because of the number of individuals involved in the Event and the fact that many infected individuals appear to be asymptomatic, attending this Event could increase my risk of being exposed to and/or contracting COVID-19.
Participant voluntarily agrees to assume all of the foregoing risks and accept sole responsibility for any consequence, including, but not limited to, personal injury, disability, and death, illness, damage, loss, claim, liability, or expense, of any kind. Participant may experience or incur in connection with traveling to or from, or attending or participating in the Event. Participant acknowledges and understands that Participant should not attend or participate in the Event unless Participant is medically able. Participant voluntarily agrees to comply with all safety requirements set forth by the California Council for Affordable Housing. Participant’s failure to comply with such safety requirements, including but not limited to wearing a mask, safe social distancing, and clean hygiene during the Event, may result in loss of right to participate at or attend the Event, immediate removal from the Event, and/or forfeiture of any registration fees for the Event.
RELEASE: Participant RELEASES, for myself, my heirs, assigns, personal representatives and next of kin, AND DOES FOREVER DISCHARGE, COVENANT NOT TO SUE, INDEMNIFY AND HOLD HARMLESS the California Council for Affordable Housing, its directors, officers, agents, employees, volunteers, and representatives, of and from any and all claims, liabilities, actions, damages, costs or expenses of any kind arising out of or relating to attending or participating in the Event. Participant understands and agrees that this Release includes any claims based on the actions, omissions, or negligence of the California Council for Affordable Housing, its directors, officers, agents, employees, volunteers, and representatives, whether a COVID-19 infection occurs before, during, or after attending or participating in the Event. Participant understands, acknowledges, and agrees that the California Council for Affordable Housing is in no way responsible for its own negligence or the negligence of third parties in connection with the Event.
PARTICIPANT has carefully read this release, fully understands its terms and conditions, understands that the terms and conditions are contractual and not a mere recital, that participant has given up substantial rights by signing it, and have signed it freely and voluntarily without inducement.
Participant agrees that this waiver and release is intended to be as broad and inclusive as permitted by the laws of the United States, and that if any one or more of the provisions contained in this Release, shall, for any reason, be held to be invalid, illegal or unenforceable in any respect, the invalidity, illegality or unenforceability, shall not impact any other provision of this Release, and this Release shall be curtailed, limited or eliminated only to the extent necessary to remove the invalidity, illegality or unenforceability.
Participant understands that this Event might not be made available or that the cost to engage in this Event would be significantly greater if Participant were to choose not to sign this Release, and agrees that the opportunity to participate at the stated cost in return for the execution of this Release is a reasonable bargain.
If Participant has signed a separate general waiver of liability connected to my participation at this Event, the terms of that waiver are wholly incorporated into this document and the terms of this document are incorporated into the separate general waiver
