COVID-19 Safety Acknowledgment

Liability Waiver and Release of Claims

PLEASE READ THIS DOCUMENT CAREFULLY AND CLARIFY ANY QUESTIONS OR CONCERNS BEFORE ACCEPTING AND COMPLETING 


WARNING! You are waiving certain legal rights, including the right to start a legal action or claim compensation if you contract COVID-19. It is your responsibility to review this COVID-19 Safety Acknowledgement, Liability Wavier and Release of Claims form (the “Agreement”) and to obtain such advice, including independent legal advice, as you feel necessary and appropriate, before accepting its terms and completing registration.

In consideration of my being permitted to register and take part in the in-person Surety Association of Canada coordinated event or meeting (the “Activity”), the receipt and sufficiency of which is acknowledged, the following is agreed:


THIS WAIVER APPLIES TO:


a. The individual participating in the in-person Surety Association of Canada (“SAC”) coordinated event or meeting (“Activity”), together with their heirs, administrators and assigns (the “Attendee”).


b. The Surety Association of Canada (“SAC”), its officers, directors, partners, employees, agents and representatives, together with its affiliates, subsidiaries, successors and assigns, and/or members (collectively, the “Indemnified Parties”).


ACTIVITY DESCRIPTION:


It is acknowledged that with this Activity, the Attendee will be engaging in certain activities which have been organized by SAC, including but not limited to meetings, events, travel to and from the event/meeting. All Attendees must carefully review SAC’s descriptions of its activities and their applicable rules.


The activities may include but are not limited to meeting in a group setting, networking, eating and drinking (at the designed venue/site or at an off-site location(s)), pre-event and post-event social activities, and travel to and from the Activity. The activities may specifically include coming into close contact with other attendees, use of and sharing of equipment and space, utilizing built infrastructure and natural environment facilities, spending time outdoors in varying weather conditions and such other activities as may reasonably be expected to occur in the context of the event or meeting (any and all of which are individually and collectively referred to in this document as the “Activity”).

DUTY TO SELF-MONITOR:


Prior to attending a SAC event or meeting, attendees are required to complete an on-line COVID-19 self-assessment in the province where the event or meeting will be held. The list of provincial on-line COVID-19 self-assessments can be found here:

There is no requirement to share the results of the self-assessment with SAC; however, attendees agree to self-monitor for signs and symptoms of COVID-19 (symptoms typically include fever, cough, and shortness of breath) and, contact SAC at surety@suretycanada.com if he/she experiences symptoms of COVID-19 within 14 days after participating or attending a SAC event or meeting.


While participating in meetings or events held by the Surety Association of Canada (“SAC”), with guidance from federal/provincial/local health guidelines, participants are encouraged to practice hand hygiene, “social distancing” and to wear face coverings to reduce the risks of exposure to COVID-19. 

DESCRIPTION AND ASSUMPTION OF RISKS:


I am aware that participating in the Activity involves many risks, dangers and hazards, which include but are not limited to:


Risk of contracting illness such as COVID-19. COVID-19 is a serious health threat and can be deadly. While the risks are increased for individuals aged 65 and over, those with compromised immune systems, or those with underlying medical conditions, the contraction of COVID-19 presents a risk to every individual. Risk of contracting this disease may increase from activities that include contact with others, equipment, or surfaces which may be contaminated. The risks associated with this disease include risk of permanent health effects and death, and serious financial harm which may be occasioned by a prolonged illness and/or death (collectively, the “Risks”).


I understand that the Risks are inherent in the Activity.


I understand the Risks may be relative to my state of fitness and health (physical, mental, and emotional), and to the awareness, care, and skill with which I conduct myself while participating in the Activity.


I understand that contracting COVID-19 can be severe and potentially fatal.


I freely accept and fully assume all such Risks occasioned during or arising from my participation in the Activity.


I, on my own behalf and on behalf of my heirs, executors, administrators, successors and assigns, forever release, discharge, save harmless and indemnify the Indemnified Parties from any and all liability for any and all claims, demands, actions, damages (including, but not limited to, direct, indirect, incidental, special, and/or consequential losses (economic/non-economic)), judgments, executions, and costs (including legal fees and disbursements) which I may have in relation to contracting COVID-19 in any way as a result of my participation in the Activity.


By choosing to participate in the Activity, I understand and expressly acknowledge that I have read and accept the terms of this Agreement, and state that I am executing it voluntarily, with full knowledge of its content, and understanding that it is binding.
