Group Ride Waiver and Release of Liability
In consideration of being permitted to participate in this ride organized by Bike Santa Cruz County (the “Organization”), and in consideration of being allowed to participate in any biking activities associated with the event, I, the undersigned participant, hereby agree to the following:
1. Assumption of Risk I understand and acknowledge that participating in a bike ride involves inherent risks, including but not limited to physical injury, property damage, or death. I freely assume all risks associated with the event, including but not limited to accidents, weather conditions, collisions with other participants or vehicles, and other unforeseen hazards.
2. Release and Waiver of Liability To the fullest extent permitted by law, I, for myself, my heirs, executors, administrators, and assigns, hereby release, waive, and discharge Bike Santa Cruz County, its directors, officers, employees, agents, volunteers, and affiliates (collectively, “Releasees”) from any and all liability for any injury, death, loss, or damage to myself or my property arising from my participation in the event, whether caused by the negligence of the Releasees or otherwise.
3. Indemnification I agree to indemnify, defend, and hold harmless the Releasees from and against any and all claims, liabilities, damages, costs, or expenses, including reasonable attorneys’ fees, arising out of my participation in the event or my breach of any of the terms of this waiver and release.
4. Medical Authorization I hereby consent to emergency medical treatment if necessary in the event of injury or illness during the event. I acknowledge that I am responsible for any medical expenses incurred as a result of participation in the event.
5. Acknowledgment of Health and Fitness I affirm that I am in good physical health and capable of participating in the event. I have no known medical conditions or physical limitations that would impair my ability to safely participate. If I am unsure about my physical condition or fitness to participate, I have consulted with a medical professional prior to signing this waiver.
6. Use of Likeness I grant permission to Bike Santa Cruz County and its representatives to use photographs, video recordings, and other media taken during the event for promotional purposes, including but not limited to social media, websites, and printed materials.
7. Compliance with Rules and Regulations I agree to follow all rules, regulations, and safety guidelines established by the Organization for the event, including but not limited to wearing appropriate safety gear (such as a helmet) and adhering to local laws and traffic regulations.
8. Severability If any provision of this waiver is found to be unenforceable, the remaining provisions shall continue in full force and effect.
9. Governing Law This waiver shall be governed by the laws of the State of California, and any dispute arising from this waiver or the event shall be subject to the exclusive jurisdiction of the courts in Santa Cruz, California.
10. Acknowledgment of Understanding I have read this entire waiver and release of liability. I understand its contents, and I voluntarily agree to the terms and conditions stated herein.
