| Join the End the Vaccine Carveout Act Coalition
As you may know, Congressman Paul Gosar introduced H.R. 4668 – the End the Vaccine Carveout Act on July 23, 2024. This bill seeks to repeal the liability shield currently granted to vaccine manufacturers under the National Childhood Vaccine Injury Act (NCVIA). In doing so, it would restore the right of individuals to pursue legal recourse in state or federal courts if injured by a vaccine.
WHAT DOES THE BILL DO? To promote the development of safer pharmaceuticals, the End the Vaccine Carveout Act: • REPEALS vaccine manufacturers’ liability shield, empowering plaintiffs to pursue civil action against vaccine manufacturers if a vaccine-related injury or death occurs. • REMOVES the statute of limitations for those seeking compensation for vaccine injuries. Under current law, only those seeking compensation for a vaccine-related death or non-fatal injury can do so within 2-3 years of the death or injury, respectively. • ELIMINATES the COVID-19 vaccines’ classification as “covered countermeasures” under the Public Readiness and Emergency Preparedness (PREP) Act, enabling plaintiffs to pursue civil action for COVID-19 vaccine-related injuries. • PRESERVES the Vaccine Injury Compensation Program (VICP), allowing plaintiffs to choose whether to pursue civil action or seek compensation through the VICP. Plaintiffs are still prevented from “double dipping” to receive both awards.
This legislation was developed with the input of many of our most trusted and experienced activists. Many of us believe that the vaccine maker liability protection put in place by the 1986 Act has caused the greatest devastation to human health in a century. Repealing this 7th Amendment violation has been the ultimate goal of much of our work for decades to reform the dangerous vaccine program. It is now time or us to push together on this effort with all of our collective strength.
