"If Governor Abbott won't protect the students and teachers in Texas, we will": SCCA files suit against the Governor of Texas
The Southern Center for Child Advocacy filed suit against the Governor of Texas on Sunday, August 8, 2021, asking the District Court of the Lone Star State's capital county to enjoin enforcement of the Governor's order prohibiting Texas school districts from issuing mask mandates in response to COVID-19's Delta variant.

Many school districts, like the Austin Independent School District,1 are located in communities that are experiencing Stage 5 COVID restrictions.
Nevertheless, Governor Abbott's Executive Order: GA 36 prohibits independent school districts in Texas from implementing mask requirements for K-12 public school districts.
Last week, the Centers for Disease Control (CDC) issued updated guidance on August 5, 2021. concluding that "[d]ue to the circulating and highly contagious Delta variant, CDC recommends universal indoor masking by all students (age 2 and older), staff, teachers, and visitors to K-12 schools, regardless of vaccination status."
SCCA alleges that the Governor's order, which represents an overreach of the authority of his office, violates the Texas constitution and state legislation guaranteeing all Texas students an equal opportunity for a public education.
