YOUR AGREEMENT WITH TRYSHY TRAVEL, LLC.
Before we make arrangements for your group trip, we require that you acknowledge the following terms and conditions. All clients are subject to change fees, service fees, and applicable content as specified herein this contract.
Temporary Terms & Conditions - Due to the Israel-Gaza conflict Our team is keeping a vigilant eye on government warnings and travel advisories. We want to emphasize that as of now, none of our group trips' destinations have received a Level 4 (do not travel) notice from the U.S. Department of State. Rest assured that we are committed to ensuring the safety of our travelers and will continue to closely monitor the situation and provide updates as necessary. Due to this nature of travel to the Middle East, all vacation packages to this area are required to obtain travel protection.
Service Fees: All personal vacation packages servicing 3 or more travelers are subject to a per person service fee of $10- $150+. This fee is non-refundable, non-transferable, and is not applied to your trip's cost in any manner, unless specifically stated otherwise in writing. Confirmation: Once your trip is confirmed, a personalized itinerary will be emailed to you with your invoice. Learn more about the contents of your itinerary here. A firm, day-by-day itinerary including the Supplier's confirmation number(s) will be provided 60 days before travel, if not sooner (pending Supplier's process, or if your vacation has been paid in full).
Understanding the Acknowledgment of Terms: By engaging in a transaction with our Supplier, you acknowledge and agree that it is your responsibility to thoroughly read, comprehend, and seek clarification on all terms and conditions outlined in the confirmation. It is imperative that you review these terms in a timely fashion and address any inquiries or concerns promptly. Failure to do so shall not relieve you of your obligations under the agreement. TryShy Travel encourages open communication and is available to address any questions you may have regarding the terms and conditions outlined therein. Your commitment to understanding and adhering to the Supplier's terms is essential to the successful execution of our business relationship.
ALG Group Contract Rates and Name Changes: If your group has entered an active contract with ALG Vacations (serviced by Apple Vacations®, Funjet Vacations®, Travel Impressions®, Blue Sky Tours®, United Vacations®, or Southwest Vacations®), the following terms apply:
A. Group Rates: To qualify for a group rate, a group must meet the minimum required number of rooms, room nights, or passengers based on the chosen property. If the group falls below the minimum, TryShy Travel reserves the right to cancel the group booking. In such cases, individual reservations may be moved to standard rates at the property’s current pricing. Group participants must adhere to the inclusions, options, and features provided to the group and may not modify these without prior approval.
B. Name Changes: Name changes for group reservations must be submitted in writing to TryShy Travel. Requests will be accepted up to the day of departure, but are subject to hotel, supplier, or airline contract provisions. Name changes may be refused at any time or subject to cancellation penalties in cases of hotel/supplier close-outs. After travel documents are issued, a $50 per person name change fee will apply. *Note: Airline name change policies may differ; refer to the airline section on your travel documents for applicable rules. *Groups are subject to property or supplier close-outs. In such cases, names may be required immediately to secure rooms or availability. Name changes at airport or property check-in for hotel-inclusive groups are not permitted.
Booking Accuracy/Legal Names: Passengers are encouraged to immediately review all aspects of their confirmation to verify (but not limited to): passenger names, mailing address, date of birth, pricing, arrival/departure airports, accommodations, organized activities on your booking confirmation, or airfare whether part of a vacation package, TryShy Travel Frequent Flyer Program, or any flight only booking. Please notify us at once if any omissions and/or corrections are needed regarding the booking details. Passenger voluntarily assumes full and sole responsibility for any and all risks and/or costs involved with failure to report such errors and/or omissions. The name, date of birth and gender that appears on your passport or government issued ID must exactly match the same such data that is listed on airline ticket(s) and booking records. We strongly recommend that you consider that certain countries will not admit a passenger if their passport expires within six (6) months of the return date of travel. Non-United States citizens may require additional documentation. Children and infants also require all such travel documents.
Payments: Full payment of your trip is due per the date shown on your invoice or confirmation. Failure to make full payment by the due date may result in the cancellation of your reservation, and/or a late payment penalty fee in the amount of up to $100 per reservation.
Refund Policy: All refund requests MUST be in writing to info@tryshytravel.com. The amount of your refund is determined by the date on which you notify us of your cancellation, the refund policy of the Supplier, and is dependent on if travel insurance was selected for your trip. The reservation and cancellation policy are applicable to all reservations without exception. In cases where we have not made your flight arrangements, please follow the airline's rules and regulations for cancellations and/or refunds.
- If you have booked a hotel room or cruise cabin with multiple people sharing the same room/cabin accommodation, it is important to note that any cancellations made after the final payment due date may result in 100% loss of all accommodation(s) payments. Any payment(s) we have received will go towards your remaining roommate's accommodation to help cover your portion of the hotel room or cruise cabin cost, or any cancellation fee incurred as a result of you leaving the trip.
Change & Cancellation Fees: Voluntary change(s) to the original itinerary may incur a service fee in the amount of up to $25 per person, per change. This includes but is not limited to date changes, name changes, addition or removal of participants, cancellations, etc. TryShy Travel's change/cancellation fee is in addition to that of the supplier's, where applicable.
Transparency in Billing: What to do if you have questions about your vacation package price:
- If you have any concerns about how your vacation package will be billed, please contact us directly.
Substitutions: Substitutions may or may not be allowed. Contact us to discuss your situation.
International Travel Guidance and Requirements: Travel Vaccinations and Medications: TryShy Travel does provide general entry requirements for each destination; however, we do not provide direct medical advice. Determining these requirements is your responsibility. However, it is strongly recommended that you consult with your medical provider and/or visit a travel clinic before the trip to discuss options for travel-related supplement vaccinations and medications, including tetanus. You are encouraged to also review the trip location/s and itinerary in connection with information from the U.S. Centers for Disease Control and Prevention, the U.S. Department of State, the World Health Organization, or other credible sources.
Disclose Additional Medications: Should you or your child(ren) plan to bring any extra travel-related medications, kindly let us know before the departure.
Information and Documentation: You are responsible for obtaining a passport and/or visa in order to travel. Passports must be valid for at least six months after your return date. You must check for and fully comply with the requirements for travel between the United States and the countries that you/your child(ren) will be traveling to or through. Visit the U.S. Department of State and the Transportation Security Administration for more information. TryShy Travel's cancellation policy will apply if a participant is unable to travel because of improper identification, passport or visa, or other requirements.
Smart Traveler Enrollment Program: We recommend that each participant sign up to receive updates from the U.S. Department of State regarding information on your country of travel.
Travel Supplier Policies: The “Taxes” category on the Travel Invoice includes air taxes, port taxes, departure fees, government fees and fuel surcharges if applicable. These costs are imposed by the suppliers and airlines and are subject to change until time of departure. TryShy Travel has no control over these taxes and fees and should they increase, your invoice will reflect this increase. While we pride ourselves on selecting top quality Suppliers, we assume no responsibility for and shall not be liable for any refund, personal injury, property damage, or other loss, accident, delay, inconvenience, or irregularity which may be caused by: (1) any defaults, wrongful or negligent acts, or omissions of the Suppliers; (2) any defect in or failure of any vehicle, craft, equipment, or instrumentality owned, operated, or otherwise used or provided by the Suppliers; or (3) any wrongful or negligent acts or omissions on the part of any other party not under our control. Suppliers reserve the right to deviate from the direct, customary and/or scheduled route or itinerary for any reason, without limitation and without notice. Passenger(s) acknowledge and agree that TryShy Travel is not responsible for Supplier deviations, delays, cancellations, mandated overnight stays, missed connections or any other condition beyond its control.
Passengers acknowledge and understand that cruise lines, tour operators, and other Suppliers have their own contracts covering cancellation penalties and other terms and conditions, and that you are bound by those contracts in addition to that of TryShy Travel. Pricing and availability may change without notice. Passengers agree that TryShy Travel is not responsible for any errors or omissions in any quotes, advertisements, including those on our website, resulting in inventory, content, or pricing discrepancies nor is TryShy Travel responsible for any errors or omissions that may occur as a result of incorrect information from third parties. Suppliers reserve the right not to honor any published prices that it determines were erroneous due to electronic, printing, or clerical error. You acknowledge this right and agree to hold TryShy Travel harmless for any actions or damages arising from Supplier pricing.
Force Majeure: “Force Majeure” means, in relation to TryShy Travel, any circumstances beyond the reasonable control of TryShy Travel, (including, but without limitation, acts of God, explosion, flood, forceful wind, fire or accident, war or threat of war declared or undeclared, acts of terrorism, sabotage, riots, strikes, civil disturbance, requisition, sickness, quarantine, government intervention, weather conditions, defects in machinery and vehicles, delay, wildlife, or other untoward occurrences). TryShy Travel shall not be liable for any loss or damage incurred by you as a consequence of any of the Suppliers being unable to perform its obligations due to the unusual or unforeseeable circumstances (a “force majeure event”) beyond the control of the party affected by the force majeure event.
Health and Safety: Clients are responsible for ensuring they are in good health and physically able to participate in the trip. Any pre-existing medical conditions or disabilities should be disclosed to us in writing prior to the trip. TryShy Travel is not liable for any medical emergencies that may occur as a result of us having no knowledge about pre-existing medical conditions or disabilities whereby we were unable to prepare or advise you properly about your decision to participate in a trip.
Clients are advised to follow local laws, customs, and safety guidelines provided by the trip hosts or guides. TryShy Travel is not liable for any legalities that may arise in any destination as a result of a participant's non-compliance to governing customs or laws. Disorderly conduct will not be accepted and will ban you from booking future trips with TryShy Travel. We encourage you to review our Group Code of Conduct and follow up with any questions or concerns you may have before travel. Additionally, compliance with international rules and regulations in the destination is the responsibility of each client.
Information on Website: The content and images contained on TryShy Travel's website (www.tryshytravel.com), including downloadable files, are protected by copyright. You agree not to use or authorize the use of this information for any purpose other than personal use, and not to engage in the resale, redistribution, and use of the information on this website for commercial purposes. This said website may contain third-party links and pointers which are included solely for your convenience and do not constitute any endorsement by TryShy Travel or our Suppliers.
Travel Protection: Travel insurance protection is strongly recommended. As your travel agency, we have a professional responsibility to recommend the purchase of travel insurance to cover certain risks inherent in travel to protect against THIRD PARTY SUPPLIER DEFAULT/BANKRUPTCY PROTECTION, DELAY, INTERRUPTION, CANCELLATION, MEDICAL EMERGENCY TRANSPORTATION/EVACUATION & REPATRIATION, BAGGAGE & PERSONAL EFFECTS/LOST LUGGAGE & BAGGAGE DELAY, ILLNESS, ACCIDENTAL DEATH AND DISABILITY, TRAVEL ACCIDENT/SICKNESS MEDICAL EXPENSES, AND MORE. PROPER INSURANCE MAY PROTECT YOU FROM FINANCIAL LOSS IN ALMOST ALL CIRCUMSTANCES. By declining appropriate travel insurance, passenger(s) acknowledges and accepts liability for any cancellation penalties, damages and/or out–of-pocket expenses incurred. If purchasing travel insurance, we urge you to thoroughly read your policy’s confirmation of benefits. This information includes, but is not limited to, details on the extent of coverage and procedures for making a claim. Please note that the travel insurance provider may not be allowed to discuss your claim with TryShy Travel due to privacy laws (e.g.HIPAA). Passengers acknowledge and agree that TryShy Travel is not a licensed insurer, licensed producer, nor do we hold ourselves to be insurance experts. We have no control over the travel insurance provider or its coverage decisions, and as a result we are not responsible for and shall not be liable for policy coverage, claims processing, or the denial of any claims.
Electronic or handwritten signature: Both parties agree that you may acknowledge and agree to these Terms: (a) electronically; (b) by handwritten signature; (c) by any other electronic means, including without limitation acknowledgment via email acceptance of these Terms; or (d) by your implied consent deemed via your actions which shall include without limitation the payment of the invoice and/ or your use of the services provided by TryShy Travel or any other travel supplier related to your booking. All such means will be deemed to constitute effective acknowledgment and execution of this Agreement and shall be sufficient to bind the parties to the terms and conditions of this agreement.
