Assess your Relationship with these Estate Planning Questions

They say April showers bring Spring flowers. These thundercloud-inducing Estate Plan questions are hard to discuss, but the result will set the groundwork for a springtime of the soul. Have you and your partner discussed some of these topics? Have you properly prepared? Don’t let fair weather fool you. When it comes to your estate plan, it may be time for some Spring cleaning. 


1)     Do you or your partner know who would take care of your children if you both were deceased? Have you named that person in legal documentation? FYI, Godparents are not legal guardians.

 

2)     If you or your partner discovered that they have a child from a previous relationship, would you add that child as a beneficiary to your estate plan?

 

3)     If you or your partner have children from a previous relationship, do you know how they would receive assets from the estate? Do you want those assets split equally?

 

4)     What if your partner inherits all your assets and then re-marries, or has new children? In the event of your partner's death, do you want your assets to go to your partner's new partner, new children, or to your children?

 

5)     Who would you trust to determine if you are incapacitated, your partner and a doctor, or two doctors without your partner’s opinion?

 

6)     If you are incapacitated, who do you want to make your financial decisions? Is it your partner, is it someone else?

 

7)     If you are incapacitated, who do you want to make your medical decisions? Is it your partner, is it someone else? Does your partner know your medical preferences and decisions?

 

8)     Does your partner know if you want to be plugged into a machine in a vegetative state? Does your family know your decision? Do they agree?

 

9)     Is your property held in one partner’s name and not the other?

 

10)  Who is named as your beneficiary of your life insurance and retirement accounts? Is it your partner? Children?
